General Terms and Conditions

We request that you read the general terms and conditions carefully. The use of the Potje App and the services that Potje offers via its mobile App is expressly conditioned on your acceptance of these terms and conditions of service. By using this App you acknowledge your agreement to these terms. If you do not agree with these terms and conditions in whole or in part, you should not use the App. We may change the terms and conditions at any time. The latest conditions will always be available on the website or in the App or brought to your attention via a hyperlink. You will in any case be notified of any changes. By using Potje again after changes, you agree to this.


1. Definitions

In these General Terms and Conditions the following definitions apply:

“Potje App (App)” is a service platform in the form of an software application that helps groups to save together.

“A pot” is a digital collection point where individuals can individually or jointly contribute money for a purpose, which is produced by the “App” as a result of a digital money transfer from the Buyer(s) to the “Merchant”.

“Merchant” is a natural person who uses the “App” and the services offered therein with the aim of receiving and spending money for the described purpose. This person is referred to in the “App” as treasurer or money boss.

“Buyer” is a natural person who uses the “App” and the services offered therein with the aim of contributing money for “a pot”.

“User” is a natural person who uses the “App” and the services offered therein with the aim of contributing money for “a pot”. "User" can be either a “Merchant” or “Buyer”.


2. Potje services

Pots are available via the Potje App, available in the Google Play Store (for Android) and in the App Store (for Apple devices). Our App makes it possible to transfer money digitally to support a cause, with social incentives to simplify saving (in groups). With the Potje App, a User can open a pot after creating an account, add other Users to the pot, add payment requests and have them settled using iDeal or other payment methods. The maximum a Merchant can receive is €3,500 per single transaction and €20,000 in total, regardless of the amount of pots.

Potje mobile App is a service platform, Potje is not a payment processor and Potje does not manage funds. Potje uses the services of Online Payment Platform B.V., this organization is licensed as a payment service provider by De Nederlandsche Bank (DNB). They are also certified as a C2C provider of iDeal. They manage Potje Technology B.V. process associated financial transactions and manage the money in a separately established foundation (Online Payments Foundation).


3. Prohibited use

We encourage Users to use the App as referred to in Article 2. The use of Potje for money laundering or for the trade or exchange of illegal products/services, for drugs or weapons, for products/services that promote hatred, violence , terrorism, harassment or abuse, for gambling services or adult entertainment products/services is strictly prohibited.

Potje Technologie B.V. reserves the right to cancel any suspicious transactions, delete any personal accounts associated with such transactions and to notify the competent authorities of suspected prohibited uses, disclosing all related information.


4. Identification steps

We strive for a smooth User experience, but to secure your financial transactions and comply with legislation, identification steps are required when:

If a Merchant wants to receive a transaction, the Merchant must link his or her bank account number. This procedure is carried out by Online Payment Platform. The General Terms and Conditions of Online Payment Platform apply. You will be charged €0.01 for linking the bank account.

Additional identification is required when a Merchant wants to receive more than €250 per transaction, the sum of all contributions for the Merchant via Potje App is more than €1500 or when the Online Payment Platform requests this. The General Terms and Conditions of Online Payment Platform apply.

These identification steps are only required once per Merchant.


5. Reimbursements Potje App

We calculate the costs as soon as the Merchant requests the transactions to be paid out to his or her bank account or when the deadline for a 1-year valid pot has been reached. The costs are deducted from the entire amount, so that every participant has contributed to the pot.

Prices per pot (including VAT)

A pot up to €100 costs €2.50

A pot up to €500 costs €5.00

A pot exceeding costs €10.00

An interim withdrawal from the pot costs €2.50

The User is solely responsible for all costs charged by third parties for access to or use of the App (such as telephone, SMS or data costs charged by the mobile provider).


6. Ownership

The copyright and ownership of the App, including individual images, graphic material, logos, text and layout, as well as the composition of the content placed in the App belong to Potje or third parties affiliated with Potje. The names of other companies and products mentioned in the App are the trademarks of their respective owners.

Under the conditions set out in these General Terms and Conditions, Potje grants the User a limited, personal, immediately revocable, non-exclusive, non-sublicensable, non-transferable right to use the App in accordance with the agreed purpose, i.e. using the App to use Potje. It is not permitted to remove, obscure, obscure or change any notices or notices relating to intellectual property rights.

Nothing in these General Terms and Conditions is intended to transfer any intellectual property rights to the User. The User will not perform any actions that may infringe the intellectual property rights of Potje, such as registering domain names, trade names, brands or logos that resemble or are identical to any object on which Potje has intellectual property rights. User may not modify, copy, distribute, transfer, display, publish, sell or license the App or any information or software related to the App. It is also not permitted to request or reuse substantial parts of the App without written permission from Potje, or to repeatedly and systematically request or reuse non-substantial parts of the App as referred to in the Database Act.


7. Data usage

All User data, both the data that the User enters himself/herself and the data created by using the App, are always treated in accordance with Potje's Privacy Statement.


8. Liability

Each Merchant is responsible for ensuring that the payment requests are distributed correctly. However, the User is responsible for checking this and pointing out any errors to the Merchant. The User downloads and uses the App at his own expense and risk, and is solely liable for any damage to the mobile device or loss of data resulting from the download or use of the App.

Potje is not liable for damages resulting from the use of software on the mobile device that has not been officially approved by the manufacturer of the mobile device operating system. The App is provided without any guarantees or warranties of any kind regarding the functionality of the App and the accuracy of the information displayed in the App.

Except for intent and deliberate recklessness on the part of Potje's management, Potje is never liable for indirect damage resulting from attributable shortcomings or defects that affect the App, nor for indirect damage on any other basis, such as tort.

Potje accepts no liability for property damage, financial damage or any other disadvantage related to the use or misuse of Potje, to the extent permitted by mandatory law. In any case, Potje is never liable for consequential damage, including pure financial damage, lost turnover and profit, loss of data and immaterial damage, related to or arising from Potje. The only action you can take if you believe you have suffered damage is to discontinue use of Potje and delete your account.

To the extent that Potje is liable despite the above, our liability is limited to direct damage up to an amount of EUR 1,000 (one thousand euros), which limitation of liability does not apply in the event of intent and/or deliberate recklessness on our part.


9. Termination

The User has the right to stop using the App and terminate/delete his profile at any time. This can be done by leaving all participated pots and deleting the account. The termination of the profile will not affect transactions that were already concluded before the moment of termination. In the event of a violation of any of the obligations and restrictions stated in these General Terms and Conditions and upon deactivation or deletion of the App from your mobile device, all rights granted to you in relation to the App will immediately terminate. Potje has the right to terminate the agreement for use of the App at any time, without Potje being obliged to compensate any damage. All amounts that the User owes to Potje are always immediately due and payable.


10. Other

Dutch law applies to these General Terms and Conditions and all disputes arising from and/or related to them.

All disputes arising from and/or related to these General Terms and Conditions will be submitted to the competent court in The Hague, unless mandatory law designates another competent court. Within 30 days after Potje intends to submit a dispute to the aforementioned court and this has been made known to the User, the User can object to this, in which case the legal rules of competence will be followed.

If any provision of these General Terms and Conditions proves to be void or voidable or becomes invalid in whole or in part for any other reason, the other provisions of the General Terms and Conditions will remain in full force and effect. Potje will replace the invalid clause with a valid clause, the legal consequences of which, given the content and scope of these General Terms and Conditions, correspond as much as possible to those of the invalid clause.

Potje may transfer all claims, powers, rights and obligations and actions related to the General Terms and Conditions. Potje may (silently) pledge all claims, powers, rights and obligations and actions related to the General Terms and Conditions to third parties and will notify the user of this. The User hereby declares to cooperate in such a transfer or pledge (if and to the extent necessary) and that in the event of such a transfer the third party will be able to exercise all rights against the User.
